Actually I didn't state it directly but did link to the policy. There is an exception made for certain wine sellers, you are right and I do have that referenced, but line #1 is that "selling alcohol on eBay is illegal." That is the main point. Frivolous disregard for this policy is evident by people using the collectible bottle loophole.

Would you care to elaborate? If you read my article in its entirety instead of hastily posting something you find to be amiss, I actually state this many times in the footnotes. Pre-approved wine wholesale is permitted for a handful of special sellers. All other alcohol is illegal to sell on eBay per their very clear alcohol guidelines. So, I'm not sure what you're argument is, but if you have one, I have already addressed it properly in this article. Maybe read the footnotes next time.

"Though selling alcohol for consumption on eBay is illegal[1]"

from your link:

"except for pre-approved sales of wine"

It's in the first sentence. And had you asked eBay about the policy you would have found out it is perfectly legal to do so. The same rules apply on there as selling it retail in most states.

Just so you know there is always more research to do before laying it down like gospel.

@KG

The model may be possible, I guess it depends on how much time I have and how many people want to see it.

For rent-seeking, I pulled:

"This viewpoint sees "profit" as obtained consensually, through a mutually agreeable transaction between two entities (buyer and seller), and the proceeds of common-law crime non-consensually, by force or fraud inflicted on one party by another. Rent, by contrast with these two, is obtained when a third party deprives one party of access to otherwise accessible transaction opportunities, making nominally "consensual" transactions a rent-collection opportunity for the third party."

My interpretation is that in this eBay market, buyers are buying with incomplete information and sometimes with false information. Since there is no normal market for Dark Lord save for the actual release at the brewery and on eBay, sellers have a bit of an advantage. Taking advantage of information asymmetry is rent-seeking. In your definition, yes, rent-seeking can be when someone lobbies government for monopoly like protections allowing them to gain extra money for services never rendered. This is essentially what I am arguing. eBay sellers are gaining money, unearned, by manipulating buyers. If someone lies and says this bottle is 1/100 when in reality it is 1/10,000; if that bottle sells for more money, that gained money is economic rent.

I'd like to point out that The Bruery is completely exploiting this new market, and might even be in on the action. They are certainly getting a cut of the rare beer pie. Here are some facts, which point to greed and a great motive for them to toss a couple cases of their own beer on ebay:

- They handed out t-shirts to the reserve society that read "I like My Beer Served Rare." Rather than emphasizing the quality of the beer, they are pointing out the fact these beer are akin to Pokemon toys.

- After their cluster fuck Inauguration Party pissed a great deal of their reserve society off, they reward them with the privilege of paying $25.00 a month to gather and taste their RARE beers (Cluster Fork), again after paying $200 to get into their special society. So while being greedy, they are further promoting the "rarity" of their beer, which furthers the hype of the bottle that will eventually make it on to ebay.

- They then push "allocations of rare beer" on the reserve society monthly. The way the sale is tee'd up, you have to get in on this sale, as these beers are rare, and might not be made again and are small batches, and did they mention rare? As a backhand to the reserve society, you will find folks at OC and SD craft beer spots with a supply of supposed 1 per customer Rare beers. Why you ask? As advertisement for their rare beer.

So instead of them making money off of quality beer, they are making money off of it being a collectors item. If you follow their newsletters and Facebook you know they have a new beer every week to add to your collection. This is not what beer is about. I wouldn't be surprised if they put their own stuff on eBay, as they seem like a greedy bunch.

By the way, if you see an eBay beer auction where the seller obviously promotes the value of the "incidental contents" -- the beer instead of the bottle -- you can report it to eBay if you're logged into your account. I have done this a couple times in the past, and eBay closed the auction.
